Above + Within LLC provides aerial documentation services, including high-resolution imagery, edited flyover video, navigable 3D reference models, and capture manifests, for commercial properties in Northern NJ and the NYC metro area. These terms govern every engagement booked through abovewithin.co or directly with Above + Within LLC.
Above + Within LLC is not a licensed land surveyor, engineer, or code inspector, and no deliverable should be relied on as a substitute for those licensed services. The navigable 3D reference model supports visual review and approximate measurements; it is not survey-grade and is not produced using ground control or RTK positioning.
Flights are subject to FAA weather minimums and airspace authorization. If a scheduled flight cannot proceed due to weather or a denied or delayed airspace authorization, the engagement is rescheduled at no additional charge. Standard delivery timelines run from the date of a completed flight, not the date of booking.
Payment terms are confirmed at the time of scope and quote, prior to scheduling. Pricing for a given engagement is subject to change based on site complexity, airspace restrictions, hazards, or operational constraints identified during scoping.
To the fullest extent permitted by law, Above + Within LLC's total liability for any claim arising from or related to services provided, whether in contract, tort, or otherwise, is limited to the amount paid by the client for the specific engagement giving rise to the claim. Above + Within LLC is not liable for indirect, incidental, special, or consequential damages, including lost profits or business interruption, arising from the use of any deliverable. Deliverables are provided for documentation and visual review purposes and are furnished without warranty of fitness for any particular regulatory, legal, or engineering purpose.
The client is responsible for confirming they have the authority to grant property access for the engagement. Above + Within LLC does not schedule a flight without confirmed authorization from the property owner or an authorized representative.
These terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles.
